A. A complaint will be investigated upon:

1. Receiving a written complaint on a form approved by the city concerning a possible violation of TMC 8.10.020 through 8.10.200; the city manager or designee shall investigate the complaint and, if there appears to be a violation, issue a written notice of violation to the owner, occupant or person in charge of the property. The second notice of violation shall be personally served or mailed by certified mail with a return receipt requested.

2. Investigation by the Talent Police Department. Nothing in this chapter shall restrict the Talent police department from investigating a violation and issuing a citation for a violation of this chapter.

B. Such notices of violation shall include the following information:

1. A description of the real property, by street address or otherwise, on which such nuisance exists.

2. A description of the conditions comprising the nuisance.

3. A direction to correct the nuisance within seven to 30 days from the date of the notice of violation.

4. A statement that unless the conditions comprising the nuisance are removed or corrected, the owner or person in charge will be cited into justice court for the violation.

C. After the expiration of the second notice of violation, the city manager or designee shall inspect the premises to determine if the owner, occupant or person in charge of the property has corrected the conditions comprising the nuisance and, if not corrected, the designee shall issue a citation in accordance with TMC 8.10.240.

D. In addition to the citation, the city manager or designee may cause a notice to be posted on the premises, or on the public right-of-way abutting the premises where the condition exists, stating the conditions comprising the nuisance and the date and time that the owner or person in charge is to appear in justice court.
