A. Funds assessed and collected specifically for storm water improvements shall be managed separately from and in addition to any applicable taxes, assessments, charges, or fees otherwise provided by or imposed as a condition of development.

B. The city shall maintain a reserve fund entitled “Storm Water SDCs.” All moneys derived from the assessed fees, including interest earned on balances in the fund, shall be used for no purpose other than those activities described as, or for the benefit of, extra-capacity facilities as designated in the capital improvement program found in the Table IV of the appendix* to the ordinance codified in this chapter.

C. The payment of the fees entitles the owner(s) of the structure or property or persons paying the fee to storm water drainage service.

D. SDC funds may be used for reasonable and customary costs of administering fees and projects funded, including repayment of debt. [Ord. 789 Art. 6; Ord. 731 Art. 5.]
