Unless otherwise defined herein, applicable definitions are set forth in TMC 13.35.030.

“City council” means the elected council by charter of the city of Talent.

“City rules and regulations” means duly promulgated rules and regulations of the city and its duly constructed departments, agents, agencies and employees.

“Commercial” means all buildings or structures which are not classified residential or industrial.

“Customer” means any individual, firm, company, corporation, association, society, group or owner who receives water service from the city.

“Dwelling unit” means a building, mobile, or manufactured home designed for residential occupancy.

Equivalent Residential Unit (ERU). The SDCs for the city’s water system charge are calculated on an equivalent residential unit (ERU) basis. A weighting factor of one is assigned to a meter size of five-eighths of an inch. Other meter sizes are weighted based on the American Water Works Association (AWWA) safe operating capacity ratings for displacement type meters for meters two inches and smaller, and compound type meters for meters three inches and larger.

“Improvement fee” means a fee for costs associated with capital improvements to be constructed.

“Industrial” means all buildings or structures in which a product is manufactured, stored or distributed, or any combination of the above.

“Manufactured residential unit” means a structure which is intended for human capacity by one or more persons, that has sleeping, eating, cooking, and plumbing-sanitation facilities and which is constructed off site in compliance with the Uniform Building Code (Oregon State Structural Specialty Code) and designed to be transported to a site for installation and/or assembly of modular components to form a permanent structure.

“Mobile home residential unit” means a structure which is intended for human capacity by one or more persons, that has sleeping, eating, cooking, and plumbing-sanitation facilities and which is constructed off site in compliance with the Oregon Department of Commerce standards for mobile homes, and designed to be transported to a site to be used as a permanent residence.

“Multifamily residential unit” means a residential structure which is occupied by one or more persons of which there is more than one dwelling structure per lot, according to approved zoning requirements, and which provides complete independent living facilities for each dwelling structure including, but not limited to, permanent provisions for living, sleeping, eating, cooking, and sanitation.

“Owner” means the person(s) who may hold title to or lease the property for which water service has or will be provided.

“Potable-domestic water” means water for human consumption.

“Reimbursement fee” means a fee for costs associated with capital improvements already constructed or under construction.

“Residential” means buildings or structures which are built to be occupied for living purposes.

Residential Units. In cases where apartment complexes are involved, a residential unit is designed as one residential unit of a dwelling.

“Service connection” means the installation which connects the water service line with the building water service, which includes, but shall not be limited to, the following: meter, meter box, meter vault, check valves, fittings.

“Shall” is mandatory.

“Single-family dwelling unit” means a residential structure which is occupied by one or more persons of which there shall be only one dwelling structure per lot and which provides complete, independent living facilities for one or more persons including, but not limited to, permanent provisions for living, sleeping, eating, cooking and sanitation.

“System development charge” means a reimbursement fee, an improvement fee, or a combination thereof assessed or collected at the time of increased usage of a capital improvement or issuance of a development permit, building permit or connection to the capital improvement. System development charge includes that portion of a water system connection charge that is greater than the amount necessary to reimburse the governmental unit for its average cost of inspecting and installing connections with water facilities.

“Water main line” means water main lines which are six inches or larger, constructed within a city right-of-way or dedicated easement.

“Water service line” means the water supply system from the water main line to the property line. [Ord. 956 Art. 2, 2019.]
