A. Credits against the improvement fee must be provided for the construction of a capital improvement, which is: (1) required as a condition of development; (2) identified in an adopted capital facilities plan; and (3) either off site or, if on site, is required to provide more capacity than needed by the development in question. The city engineer shall determine the value of the improvements with final approval of the city manager.

B. Transportation SDC credits shall be granted under the following conditions:

1. The credit is for the portion of the actual cost, as agreed before construction, of capacity in excess of that needed to serve the particular development proposed.

2. The credit shall include no cash reimbursement, unless the project is in the city capital improvement plan and planned for construction within three years.

3. The credit is for planned projects only.

If the credit is less than the SDC due, then the developer shall pay the remainder of the calculated SDCs when the credit value has been used. [Ord. 904 Art. 8, 2015; Ord. 790 Art. 8; Ord. 728 Art. 7.]
