A. The processing fee for filing an application shall be included in the city’s adopted land use fee schedule and shall include a nonrefundable handling fee as well as a deposit to be applied towards city expenses in processing a claim application. The city manager shall maintain a record of the city’s costs in processing a claim, including the costs of obtaining information required by TMC 2.50.030 when a property owner does not provide it to the city. Following final action by the city on the claim at the local level, the city manager shall send to the property owner a summary of the actual costs, including staff and legal costs that the city incurred in reviewing and acting on the claim, including as well an invoice for costs not covered by the deposit, or a refund, whichever is applicable.

B. If the property owner does not pay the amount due within 30 days, then the city shall pursue collection, including filing a lien on the property. The city manager shall cause to be recorded in the office of the Jackson County recorder a notice of lien setting out the real property description, the nature of the fee, the amount of the fee, the rate of interest, the date from which interest accrues, and the fact that the lien is subordinate only to real property taxes.
