A. Following an investigation of a claim, the city manager shall forward a recommendation to the city council that the claim be:

1. Denied;

2. Investigated further;

3. Declared valid, and waive or modify the land use regulation, or compensate the claimant upon completion of an appraisal; or

4. Evaluated with the expectation of the city acquiring the property by condemnation.

B. At the time the city manager forwards his/her recommendation to the council, the city manager shall place the matter on the city council meeting agenda of the next practicable date and the city council shall hear the matter in accordance with TMC 2.50.050 and render a decision in accordance with TMC 2.50.060. Nothing contained herein shall preclude the city council from holding one or more study sessions concerning the matter. [Ord. 774 § 4.]
