A. The finance director of the city is directed to collect the water systems development charge fees as provided for herein. The finance director of the city may use such means of collection as may be provided by the laws of the state of Oregon or permitted by the charter and ordinances of the city of Talent.

B. Failure to pay system development charges is punishable by a fine not to exceed $50.00 per day plus the amount of the system development charge.

C. If a court suit or action is instituted to enjoin any unauthorized connection to or use of the water system, or for the collection of accounts, the city shall be entitled to collect, in addition to costs and disbursements provided by statute, such sum as any court, including any appellate court, may adjudge reasonable as attorney’s fees in such suit or action consistent with ORS 20.096 when applicable.

D. The city may, without notice to the user and property owner, discontinue water service and disconnect buildings from the city’s water system if water SDC fees are not paid.
