Violation of the policies of this chapter shall be punishable, upon conviction, by a fine not exceeding $500.00 per day for each day that the violation exists prior to abatement. In the case of contaminating receiving bodies of water, with substantial evidence that the cause of pollution is due to a particular construction activity, the violator/responsible party shall be subject to all regulations established by state or federal agencies.
