“Alternative” means nonplastic substitutions for disposable service ware such as those made from paper, hemp, bamboo, wheat, seaweed, fungi, glass, sugar cane, or pasta.

“Bioplastic” means a plastic-like unit made substantially from renewable plant materials such as cellulose or starch designed to look and act like plastic, but which contaminates the traditional recycling stream.

“City manager” means the city manager of the city of Talent or the city manager’s designee.

“City-hosted event” means any event held on city of Talent property and that is the subject of a rental agreement with the city.

“City-sponsored event” means any event organized or officially sponsored by the city of Talent or any department of the city of Talent.

“Disposable service ware” means all containers, bowls, plates, cups, lids, stirrers, cutlery, hinged or lidded containers (clamshells) and other like items that are designed for one-time use for prepared foods, including, without limitation, service ware for takeout foods and/or leftovers from partially consumed meals prepared by food vendors.

“Food vendor” means, but is not limited to, shops, sales outlets, restaurants, bars, pubs, coffee shops, cafeterias, caterers, convenience stores, liquor stores, grocery stores, supermarkets, delicatessens, nonprofit organizations, mobile food trucks, vehicles or carts, and roadside stands that serve, sell, or otherwise provide food or beverages for human consumption.

“Plastic” means a synthetic material produced by the synthesis from primary chemicals generally coming from oil, natural gas, or coal. “Plastic” means, but is not limited to, polyethylene, high-density polyethylene, low-density polyethylene, polyethylene terephthalate, polypropylene, and polyvinylidene chloride.

“Prepared food” means, but is not limited to, food or beverages that are packaged, cooked, chopped, sliced, mixed, brewed, frozen, squeezed, or otherwise prepared on the premises. “Prepared foods” does not mean: (1) any raw meat product unless it can be consumed without any further preparation, or (2) prepackaged food that is delivered to the food vendor wholly encased, contained, or packaged in a container or wrapper, and sold or otherwise provided by the food vendor in the same container or packaging. It is recommended that the food vendor communicate the need to reduce plastic packaging and engage in identifying alternatives.

“Provide” means, but is not limited to, active serving, giving away, selling, delivering, packaging, and providing. [Ord. 957 § 1, 2019.]
