The following definitions apply to words and phrases used in this chapter:

“Applicant” means any person or entity who submits an application to use the Community Center for either public or private functions. The applicant may or may not be the responsible party as defined herein, but shall nevertheless have the authority as the responsible party’s agent to bind the responsible party to all city requirements concerning use, including, but not limited to, the requirements of this chapter, the requirements of any resolution adopted pursuant to this chapter, and the requirements of the rental agreement. The city may require proof of agency.

“Commercial use” means persons, businesses and organizations whose activities are profit-making in nature. Political, industrial, and professional organizations are included in this group.

“Government activities” means official activities of the city council, commissions, committees, public meetings and for city staff uses that require the larger spaces provided at the premises.

“Hazardous substance” means any substance regulated by an environmental law which poses a hazard to human health or the environment, including, but not limited to, “hazardous substances” as defined in ORS 465.200 and “hazardous chemicals” defined in ORS 654.750 or OAR Chapter 435, Division 155.

“Laws” means all codes, statutes, regulations, rules, orders, ordinances, and other legal requirements of federal, state and local governmental bodies and agencies that affect use of the premises or activities that occur on the premises.

“Premises” means all or a portion of the Talent Community Center building, grounds, appurtenances and fixtures. May also be referred to as “facility.”

“Responsible party” means the individual designated in the permit application and approved by the city who will be responsible for ensuring that all regulations related to the use of the premises are followed. Among other responsibilities, the individual will be expected to address individuals who are not behaving appropriately and to contact the city police department if needed. [Ord. 807 § 2.]
